FINDINGS <br />1. This application was reviewed as Zoning File #2516. <br />2. The property is located in the LR-IA One Family Lakeshore Residential Zoning <br />District. <br />3. <br />4. <br />D. <br />The Orono Planning Commission reviewed this application on September 20, <br />1999 and recommended approval on a vote of 4 to 2 for a variance for bluff <br />setback and to deny variances based upon the following findings: <br />A. A previous residence was located on the property until 1997 following <br />voluntary removal by the property owner. <br />B. The property is narrow with a limited building pad. The proposed house <br />location best utilizes the existing building pad and area of disturbed soil. <br />C. A house located behind the bluff setback would encroach into the <br />required 50' rear yard setback from County Road 15. <br />Existing soils and extreme slopes will not support two drainfield sites on <br />the property. Property owners have requested the City of Orono jq)prove <br />extending sanitary sewer to the site. <br />E. A garage is located within 75 ’ of the lakeshore. The building was <br />required to be removed following removal of the principal structure. The <br />Planning Commission has recommended the garage be relocated behind <br />the 75' lakeshore setback. <br />F. The garage and residence are proposed to be located on the lot well <br />screened by topography and natural vegetation not impacting lake views <br />for the marina or other residential properties. <br />The City Council finds the property is not within the MUSA, however it is <br />located immediately adjacent to sewered property within the MUSA. The <br />Comprehensive Plan recognizes Lake Minnetonka lakeshore properties as a <br />priority for providing sewer service. The proposed Comprehensive Plan indicates <br />Page 2 of 5
