Spacing should be staggered to provide a natural appearance. <br />C.Larger trees could be placed at the top of tlie slope to soften and obscure <br />the roofline of the existing residence as viewed from the lake. <br />D.The majority of the existing stumps and root systems should remain in place <br />to stabilize the slope. <br />E. Planting with the slopes must be done in a manner to avoid soil disturbance <br />A small amount of grading will occur at the base of the stairway to stabilize the <br />retaining walls and stairway. <br />Stairways are permitted within the shore setback zone to allow easier access to the <br />lakeshore along steep slopes and bluffs. The proposed stairway as shown in the <br />plan is 5 feet in width, however the maximum width allowed by code is 4 feet. No <br />hardship has been demonstrated that would allow a stairway to exceed 4 feel in <br />width. <br />The property owners and City will enter into a Restoration Agreement that will <br />ensure successful vegetation restoration to the property and protect the slope from <br />erosion. <br />The Council finds that the conditions existing on this property are peculiar to it and <br />do not apply generally to other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, light, air nor pose a fire <br />hazard or other danger to neighboring properties, would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a demonstrable hardship <br />or difficulty; is necessary to preserve a substantial property right of the applicant; <br />and would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />12.
