designee pursuant to this section. Such costs, including but not limited to reasonable <br />attorneys' fees and costs and expenses incurred in connection with collection, shall be <br />an obligation of each Owner enforceable in any way available to the city under law. <br />16.7 Right to Assess. In addition to the right of collection as stated in-Section 16.5, the <br />City of Orono may, in any assessment year, levy against the Units an assessment for <br />all costs and expenses incurred by the city or its designee pursuant to this section. The <br />assessment shall be prorated among all Units and shall be enforceable by the city in the <br />same manner as provided in Section 6 of this Declaration. <br />16.8 Exclusive Rights . The rights granted by this section are exclusive to the City of <br />Orono and may be exercised only by the city, in its sole discretion. No other person <br />or entity, including the Association, the Declarant or Owners, whether or not a resident <br />of Orono, shall be entitled to request or require the city to act pursuant to this section. <br />The rights of the City of Orono under this section cannot be rescinded, canceled or <br />amended by the Declarant or the Owners without the written consent of the City. <br />Declarant hereby reserves exclusive and unconditional authority to exercise the <br />following special declarant rights within the meaning of Section 515B.1-103(31) of the Act for as <br />long as it owns a Unit, or for such shorter period as may be specifically indicated: <br />17.1 Complete Improvements. To complete all the Units and other improvements <br />indicated on the Plat, or otherwise included in Declarant's development plans or <br />allowed by this Declaration, and to make alterations in the Units and Common <br />Elements to accommodate its sales facilities. <br />17.2 Relocate Boundaries and Alter Units. To relocate boundaries between Units and to <br />otherwise alter Units owned by it, to the extent permitted by Section 18.2. <br />17.3 Sales Facilities. To construct, operate and maintain a sales office, management otfice, <br />model Units and other development, sales and rental facilities within the Common <br />Elements and any Units owned by Declarant from time to time, located anywhere on <br />the Property. <br />17.4 Signs . To erect and maintain signs and other sales displays offering the Units for sale <br />or lease, in or on any Unit owned by Declarant and on the Common Elements. <br />■.1 <br />1
