► <br />SECTION 8 <br />ARCHITECTURAL CONTROL <br />Rp.;trirt»nnson iterations. The following restrictions and requirements shall apply <br />to alterations or. die Property: <br />a Except as expressly provided in this Section 8. and except for alterations made <br />by Declaim in consideration of its initial sale of a Umt, no structure, building, <br />addition, deck, patio, fence, wall, enclosure, window, exterior door sign <br />display, decoration, color change, shrubbery, material <br />landscaping change, nor any other exterior improvements to or alteration of ^y <br />Dwelling or any other part of a Unit which is visible from the exterior of the <br />Unit (collectively referred to as "alterations"), shall be co^enced, erected or <br />maintained in a Unit, unless and until the plans and specificatioi^ showing ^ <br />nature, kind, shape, height, color, materials and locations of the alterations <br />shall have been approved in writing by the Beard of Directors or a committee <br />appointed by it. Notwithstanding the foregoing. Declarant s written consent <br />shall also be required for alterations until Declarant no longer owns any unsold <br />Unit. <br />b. The criteria for approval shall include and require, at a imnimum. (0 <br />substantial uniformity of color, size, location, type and design m ion <br />existing improvements and topography, (ii) comparable or better qu ly <br />materials as used in existing improvements, (iii) ease of mamtenance ^d <br />repair, Civ) adequate protection of the Property, the Association. Owners ^d <br />oLupana from liability and liens arising out of the proposed alterations, and <br />(V) compliance with governmental laws, codes and regulations. <br />c. Approval of alterations which encroach upon another Unit or the Coi^on <br />Element shall create an appurtenant easement for such encroachmen <br />of the Unit with respect to which the alterations are approved; ^ <br />any easement for a deck or patio other than as originally <br />approved by resolution of the Board of Directors and a file of such resolutions <br />shall be maintained permanently as a part of the Association s records. <br />d. Alterations described in Section 18 shall be governed by that Section. <br />Procedures.
