LLC <br />a Minnesota Limited Lif i -ilitv Company <br />(Name of Subdivider) <br />THIS AGREEMENT, made and entered into this ___day of 1999, <br />by and between the City of Orono, a municipal corporation organized under the laws of the State of <br />Minnesota (hereinafter called "City"), and Tonka Ventures LLC, a Minnesota limited liability <br />company, the property owner and developer, its successors and assigns, (hereinafter called <br />"Subdivider"). <br />WITNESSETH: <br />WHEREAS, the Subdivider has made application to the City Council for final plat <br />approval of land within the corporate limits of the City legally described in Exhibit A attached hereto <br />and incorporated herein by reference (the "Subdivision"); and <br />WHEREAS, the City Council by Resolution No. 4240 adopted February 22,1999, <br />granted preliminary approval to the Subdivision, on the condition that the Subdivider enter into an <br />agreement to provide for among other things, the installation of street, water, sewer, other utilities, <br />pathways, landscaping, and any other improvements hereinafter described on the terms and <br />conditions hereinafter set forth; and <br />WHEREAS, on March 8,1999 the Subdivider and the City entered into a Subdivided <br />Agreement for completion of the subdivision ("the Agreement"); and <br />WHEREAS, it is necessary to amend the Agreement to incorporate the specific <br />conditions of approval of Resolution No. 4240 and other appropriate conditions. <br />1 <br />• i
