r <br />3. <br />4. <br />5. <br />The Orono Planning Commission reviewed this £^>plication on August 16,1999 juid <br />recommended approval by a vote of 5-0 on the proposed variances based upon the <br />following findings of fact: <br />A. The existing garage is located one foot over a sanitary sewer easement which <br />crosses the applicants property. <br />B. Relocating the garage will bring it into line with the neighboring garages. <br />C. The proposed garage in the new location will reduce the overall hardcover <br />on the site. <br />D. The neighboring property owners were present at the meeting and expressed <br />their support for the garage. <br />The City Council fmds that the conditions existing on this property are peculiar to <br />it and do not apply generally to other property in this zoning district; that granting <br />the variance would not adversely affect tndfic conditions, light, air, nor pose a fire <br />hazard or other danger to neighboring property; would not merely serve as a <br />convenience to the applicants, but is necessary to alleviate a demonstrable hardship <br />or difficulty; is necessary to preserve a substantial property right of the applicants; <br />and would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City Staff, comments by <br />the applicants and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER, AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby grants a <br />variance per Municipal Zoning Code Section 10.22, Subd. 2 for 2,746.5 square feet (30.3%) of <br />hardcover within the 75-250' zone and hardcover within the 250'-500' zone of 426 square feet <br />(33.7%) and a variance per Municipal Zoning Code Section 10.03, Subd. 14(C) for 15.6% structural <br />Page 2 of 4 <br />£
