A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.25, SUBDIVISION 6(B) <br />FILE NO. 2508 <br />WHEREAS, James Erler and Mary Erler, husband and wife, (hereinafter "the <br />applicants") are owners of the property located at 3448 North Shore Drive within the City of Orono <br />(hereinafter "the City”) and legally described as follows: <br />Lot 18, Lydiard's Park, Hennepin County, Minnesota. <br />(hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for a variance to Municipal <br />Zoning Code Section 10.25, Subd. 6(B) for a side yard setback variance of 7.6' to allow the <br />construction of a second story addition to the existing home 2.4' fi-om the property line. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br />Minnesota; <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #2508. <br />This property is located in the LR-IC Zoning District where the minimum lot area <br />requirement is 1/2 Acre. The property consists of approximately 12,632 square feet <br />or .29 acres. <br />3.The Orono Planning Commission reviewed this application on August 16,1999 and <br />reconunended approval by a vote of 5-0 on the proposed variance based upon the <br />following findings of fact: <br />A.
