In order to construct the canopy, the applicant needs an <br />amendment to the Conditional Use Permit for the Motor Fuel Station, as well as a <br />variance to locate the canopy within the front yard setback. A portion along the front <br />of the applicant's property was taken for the Highway 12 Right-of-Way easement, <br />and the front yard setback is then from that easement line. <br />PLANNING COMMISSION RECOMMENDATION: <br />To unanimously approve: <br />1.A conditional use permit amendment for the purpose of constructing a canopy <br />over the existing gas pumps. <br />2. A front yard setback variance to allow the canopy to be constructed 6' from <br />the property line, where 20' is required.
