REQUEST FOR COUNCIL ACTION <br />COftM^ii MCt:n’*NQ <br />JUL 2 6 1999 <br />CUY Oh UriUNO <br />Department Approval: Administrator Approval: <br />Name: Michael P. <br />Title: Senior Planning Coordinator <br />Date: July 22, 1999 <br />Item No.: ^ <br />Agenda Section: <br />Zoning <br />Item Description: #2308 Brook Park Realty / Tonka Ventures, 3760 Shoreline Drive <br />"Lake Minnetonka Woods" 29-unit Townhome Development - <br />Review of Trail and Utility Issues <br />On February 22, 1999 Council reached a settlement agreement with the developer and adopted <br />Preliminary Plat Approval Resolution No. 4240 for this townhome development. A Subdivider's <br />Agreement was subsequently e.xecuted in early March. <br />The developer has been proceeding to complete the requirements for Final Plat Approval, which is <br />currently scheduled for your August 9th meeting pending timely receipt of all necessary submittals. <br />However, tw'o specific issues require discussion or clarification by Council. <br />A) Trail Linkage to Co. Rd. 15 <br />Resolution 4240, Condition 13 on Page 7, requires an internal walkway (sidewalk) layout <br />that is compatible with the wooded area and constructed of an all-weather material. <br />Condition 13 also requires tliat the developer construct an 8' wide trail linkage from County <br />Road 15 northward to the area of the residential units, and requires that this linkage to be <br />paved. <br />The developer has questioned w hether Council intends that this trail be bituminous paving <br />or if it can be of more natural materials. <br />It should also be noted that this proposed trail is within the boundaries of a Flowage and <br />Conservation Easement gn. ited to the City in 1982 which prohibits "fences, fireplaces, steps, <br />docks, piers, hardcover or roads of any nature whatsoever, or any other structure or <br />improvement inconsistent with the natural state of the land". It is staffs opinion that diis <br />easement needs to be revised or extinguished at this location if the trail is to be paved. <br />Council is asked to provide direction regarding construction of this trail.
