Gappa <br />Title Director of Public Services <br />Administrator Reviewed: <br />Item Description: Spring Hill Golf Course Trail Agreement <br />Agenda Section: <br />Engineer's Report <br />Attached you will find a copy of the Spring Hill Golf Course Trail Agreement for your review <br />and consideration. This agreement is the result of a meeting that was held to review and discuss <br />the trail on Monday, June 21st. Myself, Mayor Gabriel Jabbour and Council member Dick Flint, <br />and representatives from Spring Hill Golf Club were in attendance at this meeting. The trail is <br />basically constructed with the exception of a few minor items which are noted on the attached <br />punch list with the agreement. The main item of concern is the trail on the north side of County <br />Road 6. Spring Hill has constructed a trail within the Hennepin County Right of Way. There is <br />some uncertainty about the long term availability of the easement in this area. Another concern <br />is the trail along Tamarack Drive, from the maintenance building driveway north to the wetland. <br />This portion of the trail has not been constructed yet because it would be a dead end trail at the <br />wetland. The conceptual agreement reached at this meeting was that Spring Hill Golf Club would <br />agree to trail construction along County Road 6 or along Tamarack Drive when requested by the <br />City. In the event trail construction was not completed, when requested by the City, Spring Hill <br />Golf Club would agree to be assessed for any costs associated with completion of the trail <br />construction. <br />Work on this finalizing this agreement has been ongoing all week between the two parties. The <br />Council will need to review and discuss the attached agreement. The City attorney ’s opinion on <br />this agreement will also be needed. <br />COUNCIL ACTION REQUESTED: <br />Consideration/Approval of the Spring Hill Golf Course Trail Agreement subject to approval by <br />the City Attorney.
