EASEMENT AGREEMENT <br />THIS AGREEMENT is made and entered into this day of <br />, 1999, by and between Orono Independent School District No. 278 <br />(“Orono”), an independent school district and political subdivision of the State of Minnesoia <br />(the “School District”), and the City of Orcno, a municipal corporation under the laws of the <br />State of Minnesota (the “City”). <br />WHEREAS, the School District is the owner of Outlot A, according to the plat <br />of Orono School Expansion, recorded in the office of the County Recorder in and for <br />Hennepin County, Minnesota (“Outlot A”). <br />WHEREAS, the City has relinquished by quit claim deed various easement <br />rii,Iits granted in an Easement Agreement dated December 2, 1998 recorded in the office of <br />the Hennepin County Recorder on April 13, 1989 as Document No. 5524092. <br />WHEREAS, the City has required that the School District grant to the City by <br />quit claim the easement hereinafter set forth. <br />WHEREAS, the School District desires to grant to the City such easement subject to <br />the terms and conditions hereinafter set forth. <br />NOW, THEREFORE, in consideration of One and no/lOOths Dollar ($1.00), <br />the mutual covenants herein contained and other good and valuable consideration the receipt <br />and sufficiency of which are hereby acknowledged, the parties hereto hereby agree as <br />follows; ' <br />1. The School District hereby grants by quit clzum to the City a non­ <br />exclusive easement for drainage and utility purposes and for no other purpose over, under <br />and across; <br />The West 10 feet of Outlot A; and <br />The East 10 feet of Outlot A. <br />2. The duration of the easement created herein shall be perpetual. <br />3. This Agreement shall be binding upon and inure to the benefit of the <br />respective parties hereto and their respective successors and assigns. <br />(
