SpringHill wQl, at its construct A tndl along Spring Hill Road west of Eajrt <br />Long Lalco Road and north on Tamarack to Wetland Number 12, with the following characteristios: <br />(a) The trail will be for pedestrian and cross-ccvmtty skiing use and will not be <br />designed for bicycles or snowmobiles. <br />(b) The tmi! clearing will be approdmately four feet wide. <br />(c) Wood chips, if requested by die City, will be provided as tlte traveled sui&ce. <br />4. The trail on TamarackDrive coromencing at Wetland Number iZ and north will be <br />siibjcct to future design and construction. <br />5. In addition to the construction undertaking above. Spring Hill wiU contribute up to <br />$20,000 towards trail construction in the vicinity of the golf course. <br />d.. ... City staff and engineers will participate in the layout and engmeerjuig of the trail, at <br />the.Ci^'s expense. City will be re^nsible for obtaining all permits required for the traU. <br />• # <br />7. Spring Hill agrees to transfer to the Chy two-diirds of the excess wetland mhigatiQa <br />credits resulting fiom construction of the golf course in Orono. The credits will be utilised for trail <br />system and, to the.extent any lemain, will be available to the City of Orono. The rexnainiiig one- <br />third wiU be retained by Spring Hill for possible future modiffcatioQs of the golf course, sulyect to <br />appHcahla lav^ and government approvals. Spring KtU agreea not to sell or otherwise transfer daese <br />cr^ts from the golf course site. <br />8. Spring HUi niay construct a! its expense, a rustic ^lit rail fence between the trail and <br />the golf course on those locations where, for safety and separation reasons, planting and berming is <br />not feasible. Spring Hill will not construct any fence which will prevent the free movement of wild <br />life in the area of the golf course. <br />9. The City will have re^nsibility for maintenance and repair of the trail after initial <br />eonstruetion. <br />^ a <br />10. Spring Hill will not ba Obligated to complete construction oftiie trail until completion <br />of the golf course. The parties aoUcipate that the trail will be ready for use concurrently with the <br />opening of the golf course. The final design of the trail system will be determined after the final <br />grading plans have been deteimlned and alter the rough grading for the golf course has been <br />complete. <br />11* The restrictions on the Orono Trail set forth herein shall restxwct only, that portion <br />of die trail on the right'Of-wBy donated by Spring Hill and shall not restrict the City ’s trail on its <br />Page 2 of 3
