Plat <br />May 7,1999 <br />Page 4 <br />A rail £a»ciUcut <br />The Trail Agreement (Exhibit E) in Item 1 indicates that Spring Hill will grant to the City an <br />expansion of right-of-way for the trail along Spring Hill Road and Tamarack Drive. These <br />dedications are not shown on the plat, and unless shown as expanded right-of-way, would not be <br />accepted by the County on the plat drawings. The County normally does not allow easements to <br />appear on plats except for right-of-ways or for drainage/wetlands/utilities. <br />Assuming that the City will ultunately come to a final conclusion on the trail locations, the easement <br />for the portions of such trail within Spring Hill's boundaries can be created by either of 2 options: <br />1. Dedication as additional road right-of-way on the plat; or <br />2. Granted by metes and bounds description in a separate trail easement document. <br />The attached resolution assumes that option 2 will prevail. If Council wishes to have the right-of- <br />ways of Tamarack and Spring Hill widened within this plat, then the language of the attached <br />preliminary plat approval resolution will have to be revised. ^ ^(frtSX" <br />Staff Recommendation <br />Staff reconunends approval of the proposed plat subject to: <br />1 l <br />1.Creation of Outlots A and B as unbuildable property outside the intended Club boundaries; <br />ownership of such outlots may be transferred only to an owner of adjacent land and only <br />when legally combined with that adjacent land. <br />2.Dedication of rights-of-way for Spring Hill Road, Tamarack Drive and Hunter Drive as <br />shown. <br />3. Council to provide direction regarding County request for dedication of additional right-of- <br />way along County Road 6 portions of the plat. Staff recommends no additional dedication. <br />4. On final plat, show the wetland on Outlot B. <br />5.Execution of a conservation and flowage easement over all wetlands shown on the plat, and <br />vacation of the existing easements at the south end of the site.
