r <br />DEVELOPER’S AGREEMENT FOR THE <br />PLAT OF <br />ORONO SCHOOL EXPANSION <br />(Name o£ Development) <br />ll <br />INDEPENDENT SCHOOL DISTRICT NO. 278 (ORONO) <br />(Name of Developer) <br />CITY OF ORONO <br />HENNEPIN COUNTY, MINNESOTA <br />THIS AGREEMENT, Made and entered into this 28th day <br />of, November 1988, by and between the City of Orono, a <br />municipal corporation organized under the laws of the State of <br />Minnesota (hereinafter called "City"), and Independent School <br />District No. 278 (Orono), an independent school district and <br />political subdivision of the State of Minnesota, (hereinafter <br />called "Developer"), its agents, successors and assigns. <br />WITNESSETH: <br />WHEREAS, the Developer is the buyer of the Property <br />hereinafter defined pursuant to that certain purchase agreement <br />dated June 2, 1988, as amended by that certain First Amendment <br />to Purchase Agreement dated September 26, 1988 (collectively, <br />the "Purchase Agreement"). <br />WHEREAS, Albin Thies and Arlene Thies, aka, Albin F <br />Thies and Arlene L. Thies, respectively, husband and wife, and <br />Sidney B. Phillips and Ruth L.
