2. <br />3. <br />5. <br />The property is located in the RR-IB Zoning District, where 2 acres or 87,120 <br />s.f. is the minimum lot area. The property consists of 38,346 s.f <br />The Planning Commission reviewed this application on May 17, 1999 and <br />recommended approval on a vote of 4 to 0. <br />4. The Planning Commission made the following findings rsf fact: <br />A. The lot was developed prior to the adoption of the zoning ordinance. <br />B A detached garage is located over the north property line. This non- <br />conforming structure will be removed before construction begins. <br />C. The addition will only encroach 2.1' closer to the property line. <br />D. The alley is not located entirely within the platted right-of-way creating <br />a greater distance for safe maneuvering of vehicles. <br />E.Only one additional property (540 Orono Orchard Road) requires the <br />alley for access. <br />F.The City maintains the alley as a public right-of-way and has no <br />intention to relocate the alley. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicants; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />Page 2 of 5 <br />4 <br />11 <br />i
