;; <br />i. <br />y <br />Covenam in the form attached hereto as Exhibit E. which such Covenant shall be recorded aiiainst <br />the Owners’ Lots. <br />The Association has executed a storm facility maintenance aureemeni wuli the Minnehaha <br />Creel: Watershed District for the maintenance of the drainage facility, a true and correct copy of <br />winch is attached hereto as Exhibit F. The Association shall maintain and repair titc drainage faciluv <br />witi; all applicable provisions of the City’s Code. General assessments shall be imposed upon each <br />Owner of a Lot for the purpose of satisfying the requirements of the storm water facility maintenance <br />facility agreement and for the general maintenance of the drainage facility in accordance with all <br />applicable provisions of the City’s Code. <br />To promote natural vegetation, maximize wildlife habitat, control erosion, improve water <br />quality for the benefit of the Owners of the Lots, no person shall fill, install any structure, apply any <br />herbicide, drain, burn, remove any trees, or undertake any activity which violates the rules, <br />regulations or ordinances of the Minnehaha Creek Watershed District, the U.S. Corps of Engineers, <br />the City, or such other applicable laws and regulations. <br />In addition, each Owner and future Owner of Lot 1, Block 2, Ci^stal Creek, according to <br />the recorded plat thereof, Hennepin County, Minnesota, is hereby notified that any and all land <br />ali.-raiions which affect the Type 1 and Type II wetlands delineated on Exhibit G attached hereto, <br />must be approved by the Minnehaha Creek Watershed District, the U.S. Corps of Engineers and the <br />City prior to submitting the plan for alteration to the City. This Covenant of Dedication concerning <br />Type I and T^^pe II wetlands may be changed, modified or revoked only upon written approval of the <br />Minnehaha Creek Watershed District, he U.S. Corps of Engineers and the City. <br />ARTICLE X <br />OWNER’S DUTIES WITH RESPECT TO <br />LOT MAINTENANCE <br />Section 10.1 Mailboxes . Each Owner shall maintain a mailbox of the design and type <br />initially installed by the Declarant or as on file with the Association. The mailboxes shall be on the <br />public right-of-way, and may be located in groups of two (2) or more. The Association reserves the <br />right to install or repair an Owner’s mailbox and to le\w an Individual Lot Maintenance Assessment <br />against a Lot, pursuant to the provisions of Anicle VIII hereof, should an Owner fail to properly <br />install of maintain the same. Each Owner shall have a combined Mailbox/Lot Address Post or (when <br />due to postal requirements) a separate Mailbox Post and Lot Address Post. Posts shall be obtained <br />from a supplier designated by the Association or be constructed by a prior approved <br />con.ractor/vendor in strict conformance with the Association ’s plans, details, and specifications <br />therefor. Mailboxes shall be installed in locations specified by the Association. <br />Section 10 2 Maintenance and Repair . In order to preserve the uniform and high-standafd <br />appearance of the Propeny, each Owner undertakes responsibility for maintenance and repair of the <br />exterior of his or her Dwelling, exterior yard area and private driveway on the Lot. Such <br />responsibility for maintaining the Lot and improvements thereon shall include, but not be limited to <br />the following; the maintenance and repair of exterior surfaces of all buildings on the Lot, including <br />but without limitation, the painting of the same as often as necessary, the replacement of trim and <br />DUSSED )09IR6.9 13
