1113 “Entrance Monument” shall mean one or more entrance monuments for <br />Crvs’.al Creek to be constructed by the Declarant on the real propeny ieually described on <br />Exhibit R attached hereto, and to be maintained by the Association in accordance with the <br />provisions of this Declaration. <br />1.1.14 "Lot" shall mean and refer to any lot located within tiie Propeny which is <br />platted as a residential lot and which is intended for use as, or used as, a site for a sniulc <br />Dwelling, but shall not include any Outlet located within the plat of Cry stal Creek. <br />1.1.15 “Member.” Each Owner entitled to membership in the .Association pursuant <br />to the provisions of ^^icle U. <br />1.1.16 “Mortgage ” shall mean and refer to a deed of trust, mortgage, contract for <br />deed, or other security instrument granting, creating or conveying a lien upon, a security <br />interest in, or a security title to any portion of the Pro' irty, or any interest therein. <br />• <br />1.1.17 “Mortgagee ” shall mean and refer to any entity or person named as mortgagee <br />in any mortgage deed granting a lien ("Mortgage ”) on any Lot. <br />1.1.18 “NURP Ponds/Drainage Ways” shall mean the areas reflected as Drainage <br />Easements on the Plat of Cr^'stal Creek. <br />1 1.19 "Owner.” The record Owner or contract vendee of the fee simple title to any <br />Lot. but excluding contract vendors, mortgagees or any others having such interest merely <br />as security for the performance of an obligation. <br />1.1.20 “Private Roadway” shall mean the roadway constructed over Outlot A, Crx'Stal <br />Creek, according to the plat tltereof on file or of record in the Office of the County Recorder <br />in and for Hennepin County, Minnesota. <br />1.1.21 "Property” shall mean and refer to that real property legally described in <br />Exhibit .A- attached hereto and made a part hereof <br />1.1.22 “Temporary Cul-de-sac ” shall mean a temporary cul-de-sac to be constructed <br />over the area legally described on Exhibit D attached hereto. <br />ARTICLE n <br />MEMBERSHIP AND VOTING RIGHTS IN THE ASSOCIATION <br />Section 2.1 Membership. Each Owner of a Lot is a Member of the Association. <br />Membership shall be appurtenant to and may not be separated from ownership. <br />Section 2.2 Vntinu Rights .
