ROAD, DRAINAGE /VND UTILITIES EASEMENT THIS INDENTURE, made and entered into tliis ilay oT , 19 by and between BohLand Development, Inc., a Minnesota corporation hereinafter referred to as "Grantur(s)" and the City of Oiono, a municipal corporation, its employees, interests and assigns, hereinafter referred to as "Grantee". WIINESS, THAT Grantor(s), in consideration of the sum of One Dollar ($1.00) and other go‘:d and valuable consideration given by Grantee, (lie receipt of which is acknowledged by Grantor(s), do(es) hereby grant, bargain, sell and convey to Grantee, its successors and assigns, a perpetual easement for public ingress, egress, access, road, drainage and utility purposes, over, under, above and across the land located in the Stale of Mirmesota, County of Hennepin, legally described as follows: Outlet C, Carriage Hill including, but not by way of limitation, a full and free right and authority to enter upon said land to conslnjct, install, maintain, operate, repair and rcconslriicl a sanitary sewer interceptor, lift station, main or line, a water main or line, gravel or paved road and any aiK. .ill appurtenance^, including drainage control structures and drainageways, incidental and related thereto, (such arc hereafter collectively referred to as the Improvements), and the Grantee shall have the right to make such use of said land as is reasonably necessary and advisable to the construction installation, inainlcnancc, operation and repair of the Improvements. In addition to any other remedy the Grantee may have, the covenants and restrictions contained herein may be enforced by injunction.
