5. <br />6. <br />A.The property conforms to the minimum lot width at the 75' setback, <br />where 100' is required and 113' exists. <br />B The proposed new construction removes hardcover in the northerly and <br />southerly 0-75' setbacks. <br />C. <br />D. <br />The proposed plan reduces the total amount of hardcover on site. <br />The proposed plan meets the average lakeshore, lakeshore, and side yard <br />setbacks. <br />The proposed plan conforms to the structural lot coverage requirement. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety <br />and welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.22, Subdivisions 1 and 2 and Section <br />10.56, Subdivision (L) (1&2) to permit construction of a new residence with hardcover in the <br />southerly 0-75' setback at 8.7% where none is allowed and 30% in the 75-250' setback where <br />25% is allowed. Approval was subject to the following conditions: <br />1.Applicants are advised that any changes to the plan dated January 20, 1999 and <br />most revised April 5, 1999 by Coffin & Gronberg, Inc. will require <br />reconsideration by the City Council. <br />Page 2 of 4
