r <br />This application requires the following after-the-fact variance: <br />1.Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L)(2): To allow 5,593 s.f. <br />(29.9%) of hardcover in the 75-250’ lakeshore setback, where 5,593 s.f. (29.9%) exists and <br />4,675 s.f. (25%) is allowed. <br />PLANNING COMMISSION RECOMMENDATION: <br />The Planning Conunission recommended by a 6 to 0 vote to: <br />Approve the variance based on the Staff Report. The applicants agree to remove two small patio <br />areas on the south side of the residence. <br />STAFF RECOMMENDATION: <br />Staff recommends approval of an after-the-fact variance to permit the 12' by 16' detached <br />deck based on tiie following hardships: <br />1.Much of the existing hardcover on the property could be removed, however the rock <br />is not underlain by any impervious materials. Also the rock located around the <br />driveway protects this portion of the property from erosion as much of the drainage <br />in the locality follows the slope. Planting grass would create a maintenance problem <br />as a steep slope exists. <br />2.The rock on the lakeside of the home (all outside of tne 75' sc .back) is located in an <br />areCi that does not receive any sunlight, preventing grass from growing in that area. <br />J.The gravel parking area located on the north part of the property benefits the locality <br />as it is used for parking by the home owners and provides an area for snow storage. <br />The applicants have stated plowed snow is stored on their property. Rest Point Circle <br />is a narrowly platted road and no storage area is available along the side of the street. <br />COUNCIL ACTION REQUESTED <br />To adopt or amend the enclosed resolution. <br />I <br />•I
