WHEREAS, KCHA at the public hearing provided a proposed dock location and <br />layout which as a result of the public comments at the public hearing was deemed to require <br />revisions in order to have less potential impact on navigation within the lagoon; and <br />WHEREAS, the owner of Lot 3, Navarre Cove, via a letter by his attorney Rick <br />Sheridan dated September 21, 1998 indicated a willingness to limit the future use of said Lot 3 to <br />no more than two (2) dock slips extending into Outlot B, Navarre Cove, regardless whether Lot 3 <br />is ultimately used for single family residence or duplex residence purposes; and <br />WHEREAS, on November 9,1998 the City Council held a second public hearing <br />to review the revised dock proposal and directed staff to draft an appropriate resolution approving <br />a joint use dock license to Kelly Cove Homeowners Association per the conditions set forth in the <br />staff memo dated November 5,19 ‘, ; and <br />WHEREAS, the City Council of Orono, Minnesota does hereby make the following <br />Findings of Fact in regards to this application: <br />1. <br />2. <br />3. <br />Construction and use of docks within Outlot B, Navarre Cove, has a potential <br />negative impact on public use and navigability of the lagoon, as well as potential <br />impacts on its wildlife habitat characteristics, and therefore it is reasonable for the <br />City to place limitations on the location, length, layout and number of dock slips <br />constructed within Outlot B. <br />The City has in past approvals placed strict limits on the use of Outlot B, Navarre <br />Cove based not only on the navigability and public use issues, but also based on the <br />City's land use and density standards, which act to limit to a reasonable level the <br />density of housing with direct or indirect access to Lake Minnetonka, and thereby <br />limit the negative impacts to the Lake caused by development of its shores. <br />Under Orono's zoning standards for the LR-IB Zoning District in which the plats of <br />Kelly Cove and Navarre Cove are located, each single family residence shall have <br />a minimum lot width of 140 ’ as measured at the shoreline and at the 75* lakeshore <br />setback. The 1979 plat of Navarre Cove would have been allowed no more than two <br />single family residences based on having approximately 400' of width as measured <br />along the shoreline. <br />Page 3 of 9
