This involves creation of a 4-slip dock extending <br />from Outlot A, kelly Cove to serve the remaining 4 duplex units on Lots 1-4, Kelly Cove. The Hoyt <br />property which formerly contained a duplex but is now vacant, is then limited to 2 slips regardless <br />whether it is ultimately used for single family or duplex purposes. <br />City Attorney Tom Barrett has established conditions which KCHA must fulfill for this matter to <br />be completed. Staff has drafted two resolutions in relation to this matter. The first resolution is an <br />approval for the creation of a joint use dock area to serv'e KCHA, incorporating relevant findings and <br />providing the basis on which Oroiio is approving the joint use. and incorporating approval <br />coiiditions. The second resolution is the standard Annual Joint Use Dock License approval for the <br />period 4-26-99 through 12-31-99. KCHA will have to apply for an annual joint use dock license as <br />do other joint dock users in Orono. <br />Staff Recomn'.cndation <br />The first resolution requires KCHA to execute certain legal steps or actions which may take some <br />additional time. Staff is recommending that a 1999 Joint Use Dock License be issued to KCHA <br />subject to no year 2000 license being issued until all legal requirements have been completed. This <br />makes it incumbent upon KCHA and Hoyt to finalize all legal requirements this year. <br />COUNCIL ACTION REQUESTED <br />Adopt Resolution No.___approving creation of the KCHA joint use dock area and Resolution <br />No. granting a 1999 Joint Use Dock License to KCHA.
