A RESOLUTION GRANTING VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.27, SUBDIVISION 5 AND DENYING <br />VARIANCES FROM SECTION 10.03, SUBDIVISION 9 (D) AND (F) <br />FILE #2475 <br />WHEREAS, Ronald P. Zelinsky, Jr. and Jennifer L. Zelinsky (hereinafter "the <br />applicants") are owners of the property located at 320 Tumham Road within the City of Orono <br />(hereinafter "City’’) and legally described as follows; <br />Lots 1 and 2, Chippewa Third Addition, Hennepin County, Minnesota (hereinafter "the <br />property"); and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on April 19, 1999, at which times all persons desiring to <br />be heard concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.27, Subdivision 5 and Section 10.03, Subdivision 9 (D) and (F) to <br />permit the construction of a swimming pool 90' from the front lot line and 55' from the side <br />yard adjacent to street lot line, and variances to permit an accessory structure with indoor <br />plumbing 33' from the side yard adjacent to street lot line where 100' is required for setbacks <br />in the RR-IA Zoning District. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #2475. <br />The property is located in the RR-IA Zoning District, where 5 acres or 217,800 <br />sq. ft. is the minimum lot area.
