STAFF RECOMMENDATION <br />Staff is recommending denial of the application for the accessory building based on the following: <br />A. Plumbing in an Accessory Structure requires the applicants apply for a Conditional Use <br />Permit. <br />B. Any accessory building with plumbing is required to meet all yard setbacks. The building <br />is located entirely within the front yard, ahead of the principal residence on the property. <br />C. The swimming pool is within the required yard. <br />D. Other locations may be available for locating the swimming pool on the lot that would not <br />impact current or future adjacent property owners. <br />E. A Survey is required for all existing and proposed conditions on the property. <br />Staff is recommending approval of variances for the swimming pool based on the following <br />conditions: <br />1. <br />2. <br />3. <br />m <br />The berm shown on the landscaping plan shall be constructed at a height to adequately <br />screen the pool area from areas beyond the property lines. <br />The applicant submit a survey showing existing and proposed conditions on the <br />property for both the berm and swimming pool. <br />The applicant applies for and receives a land alteration permit for the berm. If the <br />amount of fill exceeds 500 cubic yards the applicant is advised a Conditional Use <br />Permit for land alteration will be required to be approved by the City Council. <br />COUNCIL ACTION REQUESTED <br />To approve or amend the enclosed resolution.
