TO:Chair Smith and Orono Planning Commission Members <br />Ron Moorse, City Administrator <br />FROM: Paul Weinberger, Assistant Zoning Administrator <br />DATE:April 12, 1999 <br />SUBJECT: #2472 Sandra Larson <br />540 Orono Orchard Road <br />Variances—Public Hearing <br />Zoning District: RR-IB One Family Lakeshore Residential District (2 Acre) <br />Lot Area:25,668 square feet (.59 acre) <br />Application: The applicant has proposed to construct a covered porch to the west side of <br />the existing residence and to screen and existing deck on the south side of the home. It is not clear <br />when the deck was constructed because no building permit was issued or variances granted. The <br />property consists of four lots that have been legally combined. A platted 12' alley separating Lots <br />3 and 4 from Lots 20 and 21. <br />The lot was platted and developed prior to the adoption of the zoning ordinance. The house is <br />located only 15.9’ from the 'platted' alley, thus any additions or deck replacement requires variances. <br />All structures are required to meet a 50 ’ setback from the alley. (The entire house is located within <br />the 50' setback.) <br />There have been discussions with the adjacent property owner to the north, located at 500 Orono <br />Orchard Road, to potentially vacate the alley. Currently only the Larson's use the alley for access. <br />If the alley was vacated the property owners would be required to construct a private driveway from <br />Orono Orchard Road. Vacation of the alley would eliminate the setbacks required for this <br />application. Due to several issues, vacation of the alley may take some time. The applicants intend <br />to enclose the deck and construct the covered porch this year. <br />This application requires the following variance: <br />1. Section 10.28, Subdivision 5 (B): To permit a rear yard setback variance to allow an existing <br />deck to be enclosed 15.9' from the rear (alley) property line and to permit a covered porch to be <br />constructed 44' from the rear (alley) property line where 50' is required. <br />H2472 Sandra Larson <br />540 Orono Orchard Road <br />Variance <br />4/19/99 <br />Page I
