Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />1. <br />2. <br />3. <br />5. <br />FINDINGS <br />This application was reviewed as Zoning File #2451. <br />The property is located in the LR-IC, Zoning District, where 1/2 acre or 21,780 <br />sq. ft. is the minimum lot area. The property consists of .30 acre or 10,430 sq. <br />ft. <br />The Planning Commission reviewed this application on March 15, 1999, and <br />recommended approval on a vote of 5 to 0. <br />4. The Planning Commission made the following findings of fact: <br />A. The existing residence is located 55' from the 929.4' Ordinary High <br />Water Level (OHWL) of Lake Minnetonka, and is 1 1/2 stories in height. <br />The upper 1/2 story would be raised 6 1/2' to a full story. <br />B. No garage space exists on the property. <br />C. A 5' X 5' storage shed is located on the property line, and shall be <br />removed at the time the addition is constructed. <br />D. The structure would not exceed 15% on the lot. <br />E. All additional hardcover would be placed outside of the 75' setback. <br />F.The deck existing on the lakeside of the residence is non-conforming. <br />Any future replacement of the deck would require Planning Commission <br />and City Council approval. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />Page 2 of 5
