While he is <br />moving forward, his attorney Hugh Maynard has noted that that the title acquisition occurred after <br />the deadline established in the Road Agreement. <br />The deadlines were established merely to keep the process moving toward completion. Staff has no <br />problem with recommending that Council agree to extend the March 15 deadline to March 31 for <br />Otten's fee simple title acquisition (page 3 of Road Agreement). Further, staff has no problem <br />extending the April 30 deadline for MnDOT's reconveyance approval for an additional month to <br />May 31. Note that Otten has formally applied for the reconveyance (Exhibit D). <br />COUNCIL ACTION REQUESTED <br />Approve extending the March 15 deadline for Otten's fee simple title acquisition to March 31, and <br />extend the deadline for MnDOT reconveyance approval to May 31, 1999.
