The proposed plan provides a loading berth in the service area and a drop- <br />ofi/loading area for students and small truck deliveries. The proposed plan meets <br />the intent of the Zoning Code regarding loading berths. <br />The topography of the site is relatively flat with numerous non Orono protected <br />wetlands. The elevation changes from 1,034 ’ at the southwest comer to 1,000 ’ in <br />the wetland areas. The Zoning Code requires a 26 ’ wetland setback. <br />The proposed plan includes grading and filling for constmction of the middle <br />school and play fields. A stormwater management pond is required. <br />Approximately .902 acres of wetland will be filled. A land alteration permit is <br />required to grade/fill approximately 14,000 cubic yards. The Minnehaha Creek <br />Watershed District (MC\^) has jurisdiction over these wetlands and will require <br />review and approval of the grading and filling in or near the non Orono wetlands. <br />Sanitary sewer and City water will be extended to the site. <br />Access to the proposed middle school is to be provided by two driveways from <br />Old Crystal Bay Road North. <br />The new middle school complex will be on the east side of Old Crj'stal Bay Road <br />North across the road from the high school complex. This will re.sult in increased <br />pedestrian crossing of Old Crystal Bay Road. <br />The City Council finds that granting a conditional use permit to allow land <br />alteration and a new middle school will not be detrimental to the health, safety or <br />general w'elfare of the public, would not adversely affect light, air nor pose a fire <br />hazard or other danger to neighboring properties, nor will its use depreciate <br />surrounding property values and that the proposed level of use of the property will <br />be in keeping with the intent and objectives of the Zoning Code and <br />Comprehensive Plan of the City. <br />Page 3 of 11
