A RESOLUTION GRANTING <br />A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 19-21 <br />FILE #2467 <br />WHEREAS, Steve Bohl, Bohland Development, (hereinafter "the applicant") has <br />an interest in the property located at 8xx Brown Road South within the City of Orono (hereinafter <br />"City") and legally described as follows: <br />Lot 1, Ceirriage Hill, Hennepin County, Minnesota (hereinafter "property"); and <br />WHEREAS, the applicant has applied to the City for a conditional use permit to <br />allow for construction of a driveway to be located in King Street and shared with 77S Brown <br />Road South where grading is proposed within 5 ’ of the property line per Section 10.03, <br />Subdivisions 19-21. <br />Miimesota: <br />1. <br />2. <br />3. <br />4. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />This application was reviewed as Zoning File #2467, a subdivision for property <br />located at 1025 Brown Road South known as "Carriage Hill." <br />The property is located in the RR-IB Rural Residential District. <br />The lot consists of 20.8 acres where 6.0 acres is dry buildable. <br />The proposed driveway is proposed to be shared with the adjacent northerly <br />property at 775 Brown Road South. No other residential lots shall be served by <br />the proposed driveway. <br />5. King Street is a platted, unopened public street. <br />Page 1 of 4
