Attached is a denial resolution to be adopted by the City Council. <br />This application required the following variances; <br />1.Section 10.22, Subdivision 1 (A) and (B) to permit structure within 75' of the lakeshore and <br />within the Average Lakeshore Setback of adjacent residences. <br />2.Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L) (1) to permit 878 s.f. <br />(7.8%) of hardcover in the 0-75' lakeshore setback where 710 s.f. (6.3%) exists and none is <br />^low^. However, all existing hardcover within 75' of the lake is legal as it has existed for <br />many years, or is permitted as a walkway to the lake. <br />3.Section 10.56, Subd. 16(C)(6): Average Lakeshore Setback. No principal or accessory <br />structure shall be located closer to the lakeshore than the average distance from the shoreline <br />of existing residence buildings on adjacent lots. The average lakeshore setback line shall be <br />a straight line connecting the most lakeward protrusions of the residence buildings on the <br />immediately adjacent lakeshore lots. <br />COUNCIL ACTION REQUESTED <br />To adopt or amend the enclosed denial resolution. <br />1
