A. The front yard is on Bay side Road. <br />B.Hennepin County has approved a driveway curb cut for a 14-22 ’ <br />driveway. <br />C.The septic sites are staked and were protected during the installation of the <br />driveway. <br />5.The City Council finds that granting an after-the-fact conditional use permit for <br />land alteration to grade the subject property to install a driveway where 1,500- <br />2,500 cubic yards of soil were disturbed will not be detrimental to the health, <br />safety or general welfare of the public, would not adversely affect light, air nor <br />pose a fire hazard or other danger to neighboring properties, nor will its use <br />depreciate surrounding property values and that the proposed level of use of the <br />property will be in keeping with the intent and objectives of the Zoning Code and <br />Comprehensive Plan of the City. <br />6.The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by staff and comments of <br />the applicants and the affect of the proposed use on the health, safety, and welfare <br />of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the Orono City Council <br />hereby grants an after-the-fact conditional use permit per Municipal Zoning Code Section 10.03, <br />Subdivisions 19 and 21 for land alteration of 1,500-2,500 cubic yards of soil to establish a <br />driveway as shown in Exhibit A, subject to the following conditions: <br />1. The debris on the subject property shall be removed and disposed of in <br />accordance with City and State statutes. <br />2. The applicants shall obtain a land alteration permit. <br />3.The address for the subject lot shall be changed to a number in sequential order <br />on Bayside Road. <br />Page 2 of 5
