PLANNING COMMISSION RECOMMENDATION: <br />The Planning Commission recommended by a 5 to 0 vote to: <br />Deny the variances based on the following reasons: <br />1.The Council issued variances in 1995, with the condition that no new structure or hardcover <br />be placed closer than the DNR setback of 50'. <br />2. <br />3. <br />The applicant constructed a deck without a building pennit. <br />The DNR recommended denial of the application in 1994 because it would encroach into <br />their 50' lakeshore setback. <br />STAFF RECOMMENDATION: <br />To recommend denial of the application based on no apparent hardship. <br />COUNCIL ACTION REQUESTED <br />To direct Staff to prepare a resolution to be presented at a future meeting. <br />J
