COUNCIL MEETING <br />SERVICE 800 BRIMHALL ACCESS OPTIONS - UPDATE 1-25-99 2 5 {999 <br />Cl ry OF OHONQ <br />Service 800 would like to begin construction as soon as possible, but the preferred access options <br />would not be approved by MnDOT for at least 2-3 months and might take possibly up to a year for <br />final action. <br />Service 800 would like to begin construction of their building using the existing right-in/right*out <br />curb cut on a temporary basis. As soon as MnDOT approval can be obtained for one of the <br />following 2 options, they would construct a new access across from Brimhall per the revised site <br />plan submitted Friday (attached) with parking against Highway 12 frontage rather than against fixmt <br />of building. <br />1.OPTION 1. Cliff Otten will request that MnDOT reconvev the triangle to him. For this to <br />happen, Otten must acquire the underlying fee title to the triangle from the Daniels heirs. <br />Otten would ultimately pay MnDOT the appraised value of MnDOPs road easement. Staff <br />will support this program only if: <br />a. <br />b. <br />Otten is willing to grant/dedicate to the City a 70' right-of-way corridor (Code Section <br />11.33 Subd. 4) within the triangle across from Brimhall, extending from Highway 12 <br />to the north line of the triangle, for use as a future public road, and is willing to grant <br />to Service 800 an easement across the remainder east of said corridor. <br />Service 800 builds a driveway access to Highway 12 within the easement and right- <br />of-way corridor. <br />2. <br />We would want Otten to complete acquisition of fee title from the Daniels heirs wdthin a <br />short timeframe (30 days), and if he can't do so, we would proceed to Option 2. <br />Anticipated schedule to complete Option 1 (reconveyance): <br />60-day MnDOT staff review <br />6-9 months to finalize paperwork (appraisal for value of easement being <br />extinguished, title transfers, paperwork) <br />Potential Pitfalls: <br />Daniels heirs may expect more than Otten is willing to pay for fee title <br />MnDOT appraised for value of easement might be more than Otten will pay <br />MnDOT staff may find a reason to retain their easement and deny <br />reconveyance <br />OPTION 2. City will formally apply to MnDOT for turnback to City of MnDOT’s <br />easement over the triangle, based on: <br />a. City intends to have a future public road access at this location, per 1988 Comp <br />Plan Amendment No. 2, with future connection to service road corridor extending <br />east-west between Brown Road and Willow Drive.
