TO:Chair Hawn and Orono Planning Commi‘:sion <br />Ron Moorse, City Administrator <br />FROM: <br />DATE: <br />Paul Weinberger, Zoning Administrator/Planner <br />October 13, 1999 <br />SUBJECT: #2537 Adult Use Ordinance <br />The City of Orono has adopted a moratorium on adult uses that is to expire on November 12,1999. <br />In order to be prepared for any requests after the moratorium has expired it is imperative the City has <br />an adult use ordinance in place. Adult businesses are protected by the First Amendment as a <br />freedom of expression. An ordinance will ensure the City that any requests for adult oriented <br />businesses can be regulated by hours of operation, signage, parking and location. <br />Summary of Draft Ordinance <br />Other communities have recently adopted ordinances relating to adult uses. The prop>osed ordinance <br />for your consideration incorporates similar components typically addressed and interpreted in other <br />adult use ordinances with our ordinance. Most adult use ordinances separate adult uses into two <br />categories. Principal uses and Accessory uses. Principal adult uses relate to on-site consumption <br />wliere the sole or a dominant activity is located on the premises of the adult business. Accessory <br />adult uses w. uid include primarily off-site consumption with total retail space dedicated for adult <br />uses being 10% or less of the retail space, and not to exceed 150 square feet. <br />Principal uses would be allowed in the I, Industrial District, and accessory uses would be allowed <br />in the I and B-1, B-3, B-4, B-5, B-6, Business Districts where the primary use of the business is a <br />permitted or conditional use. The B-2 district is for marina use. All our marinas are immediately <br />adjacent to residential properties. The intent is to allow adult uses in concentrated commercial and <br />industrial areas not to negatively impact residential properties and neighborhoods. <br />Protecting residential areas, schools, day care facilities, churches, libraries, parks and other public <br />places as well as places where a high concentration of children would be present is another purpose <br />of the ordinance. Locations adult uses are permitted - Principal. <br />Adult uses principal would be conditional use and shall be located at least 250 feet from the closest <br />point of »he building or actual leased space of the adult use principal to the property line of: <br />1. <br />2. <br />3. <br />4. <br />D. <br />6. <br />A licensed day care center <br />Public or private educational facility (K-12) <br />A public library <br />A public park <br />An on-sale liquor establishment <br />Churches and church related facilities <br />Aduh Use Ordinance U2537 <br />IQ/18/99 <br />Pjge I
