Subd. 3. Prohibition. No person shall operate a sexually oriented business except In <br />conformity with the provisions of this Section. <br />Subd. 4. Location of a Limited Impact Business. An limited impact business may <br />locate in any zone as a part of a permitted or conditionally permitted retail use. <br />Subd. 5. Location of a Hioh Impact Business. <br />A. <br />B. <br />A high impact business may locate only in the zone(s). <br />No person shall operate a high impact business on property, any part of <br />which is within the area circumscribed by a circle which has a radius of <br />_______feet from any of the uses listed below. Distances shall be <br />measured by following a straight line, without regard to Intervening <br />structures or objects, between the closest points on the property lines <br />of the two uses. This distance requirement applies to the following uses: <br />1. <br />2. <br />3. <br />property developed or zoned for residential uses; <br />property located in a major recreation zone; <br />property frequented by children or designed as a family <br />destination, such as a day care facility, school, library, park, <br />playground, state or federal wildlife area or preserve, religious <br />Institution, and other public recreational facility; <br />4.premises licensed under City Code Chapter <br />beer and wine licensing; and <br />, relating to liquor. <br />5. another high impact business. <br />Subd. 6. Operation of Business. <br />A. Both the owner of a sexually oriented business and the manager of the <br />business shall be responsible for the conduct of their employees and for <br />compliance with this Section. <br />B. No owner or manager of a sexually oriented business shall employ a <br />person under the age of 18. <br />C. No owner, manager, or employee of a sexually oriented business shall <br />have been convicted of violating this Section three or more times v/lthin <br />24 months. <br />C- 5
