Duncan MacMillan has applied for a conditional use permit to allow land alteration of greater <br />than 500 cubic yards and to permit grading within 5' of the propert>^ lines for redirecting a driveway <br />access further to tfie east across a commonly owned property line. A 40 foot wide access easement <br />would be granted by the 1700 Fox Street lot to the 1820 Fox Street lot. <br />The existing driveway is quite steep. The proposed driveway would be at an 8% slope and the <br />landing to Fox Street would be only 2%. The proposed drive would greatly reduce the overall slope <br />for a driveway. <br />Pertinent Ordinances <br />Section 10.03, Subdivision 21 The property owner is required to apply for a conditional use permit <br />because the total land alteration will exceed 500 cubic yards. <br />Section 10.03, Subdivision 21 (C) Conditional Use Pemiits are required for grading within 5 ’ of <br />adjacent residential property lines. <br />H2524 ir.
