MEMO <br />CITY OF ORONO <br />TO:Chair Hawn and Orono Planning Commission <br />Ron Moorse, City Administrator <br />FROM: Paul Weinberger, Zoning Administrator/Planner <br />DATE:August 12,1999 <br />SUBJECT: Review for Special Consideration within the Sugar Woods Plat <br />2102 Sugarwoods Drive (Todd and Anita Kimmes) <br />The City Council has approved a special review procedure for requests tliat do not meet the <br />covenants and special zoning requirements within Sugar Woods. The Planning Commission <br />assumes the sole responsibility for the review and final recommendation regarding requests for <br />special consideration. The applicant however, does have the right to appeal a Planning Cotiimission <br />decision to the City Council at their next available meeting. <br />Please review the attached Supplemental Sheet to Building Permit Application for Residential <br />Development within Sugar Woods (Exhibit G). Please pay special attention to paragraph 3 and <br />Attachment B. <br />Todd Kimmes has submitted a Building Permit application for Lot 2, Block 4 (2102 Sugarwoods <br />Drive) for a new residence. The special conditions placed on the development require any <br />improvements that occur on the property must do so within the required building setback. Setback <br />requirements for this lot are fiont 50', rear 50' and side 30'. The proposed driveway is a hardcover <br />improvement and would be required to meet the 30' setback by the approvals granted within the <br />subdivision. Applicant is requesting a driveway 10' fi:om the side property line. <br />Please review the attached letter submitted by the applicant explaining the special conditions that <br />apply to the property (Exhibit D). Letters supporting the plan have been submitted by the adjacent <br />property owner and the Architectural Committee of Sugar Woods. They are attached as Exhibits E <br />and F. <br />PLANNING COMMISSION ACTION REQUESTED <br />Motion to approve or deny the request for special consideration to allow a driveway to encroach 20’ <br />into the required 30' side yard setback.
