TO: <br />FROM: <br />DATE: <br />RE: <br />Chair Hawn and Orono Planning Commissioners <br />Ron Moorse, City Administrator <br />Kris Jenson, Assistant Zoning Administrator/Planner <br />August 9,1999 <br />#2515 Tom and Maureen Palm, 1685 Concordia Street <br />Variances—Public Hearing <br />Zoning: LR-1C, One Family Lakeshore Residential District 1/2 Acre <br />Application: To construct a new garage in a new location, as the existing garage is partially located <br />widiin a sewer easement. <br />STAFF SUMMARY <br />Tom and Maureen Palm have submitted an application to construct a lew 30' x 30' garage <br />in a different location than the existing 24' x 26' garage, as it is partially located over a sewer <br />easement. <br />The existing garage is located 98' from the rear property line (street side). The proposed <br />garage would be located 48 feet from the same property line. The proposed garage is 30' x 30', for <br />a 900 sq. ft. structure. Because the structure is defined as oversized, due to the fact that it is larger <br />than 750 sq. ft., the sideyard setbacks are required to be 15', rather than the district 1 O' standard. The <br />applicant's could reduce the size of the garage to 750 sq. ft. by reducing the garage 5' in depth. This <br />would allow the applicant's to maintain a 3 car garage, and still meet the 1 O' setback requirements. <br />The proposed height of the garage is 23'. <br />This lot is over on hardcover, although the proposal will reduce the hardcover, due to the <br />garage being moved to the rear of the lot. The question is how much the Commission wants the <br />hardcover reduced. The other issue is structural coverage. The lot currently sits at 14.9% structural <br />coverage. <br />Pertinent Ordinances <br />► Section 10.22, Subd. 2, Lakeshore Hardcover and Land Alteration Regulations. Within 75 <br />to 250 feet of the shoreline there shall be no greater than 25% hardcover. Within 250 to 500 <br />feet of the shoreline there shall be no more than 30% hardcover. <br />»• Section 10.03, Subd. 9, Accessory Buildings, (E) Setbacks. Accessory structures in excess <br />of 750 square feet footprint area but not exceeding 1,000 square feet footprint area shall be <br />located at least 15' from any lot line. <br />»• Section 10.03, Subd. 14, Yards and Open Spaces, (C) Lot Coverage. In all zoning districts, <br />for all lots of 0-1.99 acre in total area, the total combined footprint areas of all principal and <br />accessory structures shall not exceed 15% of the lot area.
