L <br />TO: <br />FROM: <br />DATE: <br />RE: <br />Chair Havvn and Orono Planning Commissioners <br />Ron Moorse, City Administrator <br />Kris Jenson, Assistant Zoning Administrator/Planner <br />July 6,1999 <br />#2502 Bill Wear, 2160 Wayzata Boulevard <br />Amend Conditional Use Permit Amendment, Variances-Public Hearing <br />Zoning:B-1, Retail Sales Business District <br />Application: To amend the Conditional Use Permit to add a canopy, and a variance to allow <br />the canopy to be 6' from the property line. <br />STAFF SUMMARY <br />A zoning application was submitted and reviewed by the Planning Commission two years <br />ago on the same request. The Planning Commission voted to recommend that the variance be <br />approved, conditional upon Staff review of the height of the canopy, a lighting plan, and signage; <br />removal of a portable sign and reinstallation of the pylon sign; and comer angles on the front of the <br />canopy. This item did not proceed to the City Council as Staff did not receive a canopy plan from <br />the applicant. <br />Mr. Wear has resubmitted his application for a canopy at the Orono Self Serve. The <br />proposed canopy is approximately 15' in height (to the underside) will have angled comers on the <br />front, in order to maximize the distance between die canopy and the overhead power lines. Lighting <br />under the canopy will be recessed, and information regarding the lighting is included in the exhibits. <br />A review of the photometric plan shows minimal amounts of light spilling over the property line. <br />Signage has not l^en reviewed as a part of this application, and Mr. Wear must bring any proposed <br />signage to the Planning Commission for their review. <br />The proposed canopy requires a conditional use permit amendment and a variance. Motor <br />Fuel Stations are a conditional use within the B-1 Retail Sales District, and a canopy is an accessory <br />to the conditional use, which was originally granted in 1972. The variance is required for the front <br />yard setback, as the applicant's front yard was reduced when the State took land for the reconstructed <br />Highway 12 right-of-way easement. <br />Pertinent Ordinance <br />Section 10.40 B-1 Retail Sales Business District, Subd. 6, Setback Requirements (C) Front Yards. <br />The minimum front yard shall be 20'. <br />t2S02 Bill Bear.
