Stables and Barns <br />The keeping of domestic animals for non-commercial purposes is a permitted use including horses <br />for the use of the occupants of the premises. A minimum of one acre in aggregate, exclusive of one <br />acre for the principal building, must be available for each animal unit, except as hereinafter set forth. <br />A minimum of two acres of open pasture must be available for a single horse and one additional acre <br />must be available for each additional horse. When the horses are kept stabled and do not require <br />pasture for feed purposes, the minimum pasture requirement may be adjusted at the discretion of the <br />Council. Such minimum pasture acreage shall not include low lying lands unusable for pasture or <br />grazing. Any person keeping such animals must comply with the provisions of the City Code. <br />The use of an accessory building for keeping animals for non-commercial purposes is a permitted <br />use provided it is for the non-commercial use of the property owner or resident and meets the <br />available area standards outlined in the paragraph above (Section 10.20, Subdivision 3 (M). Further, <br />no such structure shall be located less than 1 SO feet from the nearest adjacent residence and no closer <br />than 75 feet from the nearest lot line. <br />The use of accessory buildings or land for the storage or rearing of animals not owned by the <br />property owner or resident is allowed by conditional use permit. Fiuther, no such structure sh^l be <br />located less than 150 feet from the nearest lot line. <br />Any such instruction maintained as an accessory use and conducted by the owner shall be a <br />conditional use permit and meet the requirements listed above and no such instruction shall occur <br />less than 100 feet from an adjacent residence or less than 75 feet from the nearest lot line. <br />Right-of-Way Dedication <br />Watertown Road is a City owned right-of-way. The property was platted to the center of the street. <br />Subdivision Code requires the north 33' of Watertown Road be dedicated to the City. The portion <br />of the property dedicated is not considered as lot area. <br />Old surveys on the property show a small piece of the property crosses Watertown Road and extends <br />to the south side of the road. The south 33' of right-of-way shall be dedicated as right-of-way and <br />the property located to the south be designated an outlot. <br />The west 33' along Orchard Park Road shall be dedicated for right-of-way purposes. <br />92491 Deborah U Scholl <br />4100 WaurtoMm Road <br />Sketch Plan Review <br />5/17/99 <br />Page A
