Steven and Jo Webster, property <br />owners of 500 Orono Orchard Road, have requested the City consider a lot­ <br />line rearrangement, vacation of the alley, and variances to permit construction <br />of a garage within the required yard setbacks. <br />The 540 Orono Orchard Road lot is owned by Kent and Sandra Larson. To <br />permit a subdivision of a lot line rearrangement the Larson’s must be a co­ <br />applicant. They are not supportive of the change in access to their property. <br />They would be required to construct a driveway with access from Orono <br />Orchard Road. This property uses the alley for its only access. <br />The Webster’s at 500 Orono Orchard Road have proposed a garage and <br />residential addition that would place the garage on the property line adjacent <br />to the alley. (Please see the attached site plan). The garage is required to <br />meet a 50 ’ setback from the property line, however variances have been <br />granted that allow structures to be located closer to the alley, but none have <br />been approved that would place a building on a property line. ______ <br />Pertinent Facts <br />1.500, 540 and 550 Orono Orchard Road all have legal access and rights to the alley. The <br />portion of the alley located to the South have been vacated. <br />2.Replacement of the driveway for access to 540 Orono Orchard Road would require <br />construction of a substandard driveway. The City encourages an 8% slope.
