Gamble, HI and Quatro Oil Ventures, Inc. (hereinafter "the <br />subdividcrs"), on Septerpber 23, 1994, filed a formal subdivision application with the Cit>- for <br />approval of a two .lot^esidential plat of propeny legally described as: <br />*. <br />Outlor"‘12,*'Paintcrs Creek, according to the plat on file in the office of the County <br />Record^wf Hennepin County, Minnesota (hereinafter "the property"); and <br />WHEREAS, after due published and mailed notice in accordance witli Minnesota <br />J^tatutes 462.358 et. seq. and the City of Orono ’s Zoning and Subdivision Ct^es, the Orono <br />Ipiannins Commission held a pu(tlic hearing on October 17, 1994 at which lime all persons <br />rdesirpa to be heard concerning ^is application were given the opportunity to speak thereon: and <br />WHEREAS, at.their regular meeting held on November 14,1994, the Orono City <br />‘cfouiicil considered the subdivision application of the subdividers, noting the foliov'ing findings <br />! )f fact: <br />1. The propertyls located within the RR-1A Single Family Rural Residential Zoning <br />District requiring a minimum of 5 acres of dry buildable land within each newly <br />created lot^ <br />2. ' The pfoperr/ consists of 13.38 acres of dry' lands. Lot 1 consists pf 6.8 acres, <br />and \joi 2 consists of 6.51 acres. The lots do not meet the required lot width of <br />300 ’ to the rear of the 100 ’ street/front setback. The Planning Commission <br />approved the width variances based on the following unique findings and <br />hardships: <br />a.
