ANALYSIS <br />Variance <br />^ u .. r <br />STATEMENT OF HARDSHIP <br />The applicant's have included their statement of hardship as Exhibit A. The applicant should also <br />be asked for his testimony regarding this issue. <br />Issues <br />1. A boathouse had existed on the property until it was removed by the property owner in 1982. <br />2 <br />3. <br />%« <br />The application is for new construction, all within the 0-75' lakeshore setback. <br />The City of Orono recognizes the importance of water quality for Lake Minnetonka and has <br />adopted a Comprehensive Plan and Zoning Code establishing a 75' lakeshore setback for all <br />hardcover. The intent is to allow stormwater to be absorbed into the ground to filter all <br />impurities before the water enters Lake Minnetonka. <br />4.To protect lake views for adjacent property owners and future property owners, the City <br />requires all structure to meet an average lakeshore setback. No principal or accessory <br />structure shall be located closer to the lakeshore than the average distance fix)m the shoreline <br />of existing residence buildings on adjacent lots. The average lakeshore setback line shall be <br />a straight line connecting the most lakeward protrusions of the residence buildings on the <br />immediately adjacent lakeshore lots. <br />STAFF RECOMMENDATION <br />Staff is recommending denial of the application based on no apparent hardship that would require <br />and accessory building to be located along the lakeshore and over another portion of the property. <br />.Allowing development of structure would be an adverse impact to Lake Minnetonka by <br />compromising water quality by allowing new structure in the 0-75* lakeshore setback, and having <br />a visual impact for adjacent property owners and from the lake. <br />U245} John Ericson <br />1620 Shadywood Road <br />yarianees <br />2/16/99 <br />Pagii
