« i <br />Application Date: 10/17/00 <br />60 Day Deadline:imj/OO <br />TO: <br />FROM: <br />DATE: <br />SUBJECT: <br />Chair Hawn and Orono Planning Commission Members <br />Ron Moorse, City Administrator <br />Paul Weinberger, Zoning Administrator/Planner <br />November 13,2000 <br />#2636 Gaiy and Susan Cable <br />3532 Ivy Place <br />Variances - Public Hearing <br />Zoning District: <br />Application: <br />LR-IC One Family Lakeshore Residential District (1/2 acre) <br />Kr:.^ • <br />1)Request for a variance to permit an accessory building to remain on a property following <br />removal of the principal structure. <br />2)Variances to permit future structural maintenance to a non-conforming structure and to <br />permit 3,346 s.f. of hardcover on the property where 3,296 s.f. is allowed. <br />Pertinent Code Sections: <br />1.Section 10.22, Subdivisions 1 and 2 limits the location of structures and hardcover within <br />75' of the lakeshore. <br />2.Section 10.56, Subdivision 16 limits the haidcover allowed on a property. <br />3.Section 10.03, Subdivision 9 limits accessory buildings to being constructed on lots only <br />after construction of the principal building. The City of Orono has required accessory <br />buildings to be removed when principal buildings are removed. (A permit was issued by the <br />City of Orono to demo the principal dwelling on the property on 9/7/00 -- The building has <br />since been removed for construction of a new residence) <br />Building Permit: <br />The application received on 10/24/00 requested variances to allow hardcover in excess of 25% for <br />the new house and driveway. Revised plans were received from the contractor on 11/13/00 that have <br />reduced the hardcover in the 75*250' setback to under 25% (3,250 s.f.). The contractor has requested <br />a building permit tor construction of the house not requiring any variances. As noted in the <br />following paragraphs, the methods for reducing the hardcover leave questions regarding the viability <br />of the proposal, since needed sidewalks are eliminated and driveway apron reduced to a questionable <br />layout <br />12636 Gary and Susan Cable <br />3532 Ivy Place <br />Variances • Public Hearing <br />Page 1
