Hall, 80 Leaf Street, with the understanding the Applicant can only replace the <br />existing deck in the amount of 174 square feet. <br />Hawn noted 60 square feet of the deck would need to be removed. <br />Smith inquired whether the deck has been completed. <br />Hall stated the deck is only SO percent completed. <br />VOTE ON THE ABOVE MOTION: Ayes 7, Nays 0. <br />(#8) #2611 MARLYS MCCARTY, 225 TONKA AVENUE, EASEMENT VACATION, <br />10:31 p.m. - 10:37 p.m. <br />Marlys McCarty, Applicant, was present. <br />Weinberger stated the Applicant has requested a vacation of a drinage and utility easement <br />located through the center of the property. A 20 by 100 foot portion of Brook Street on which <br />the detached garage is currently located was vacated by the City of Orono in 1984 per <br />Resolution No. 1619. <br />The property owner has recently acquired the property north of the vacated Brook Street. The <br />property owner has stated the current location of the easement is an obstacle and deterrent in <br />plans to improve the property. The Applicant would like to construct an attached garage to the <br />existing house. A condition of the vacation was that the property owner grant to the City a <br />utilities and access casement over the northerly 15 feet of the vacated Brook Street. <br />Weinberger stated in exchange for the 15 foot easement, the property owner would provide an <br />access and utility easement over the south 15 feet of the property. TTie new easement would <br />make it possible to provide sewer service and access if the lot to the west ever required the <br />access. There is a sewer stub made available about 100 feet north of Tonka Avenue to provide <br />service to the property north and west of the Applicant’s lot. <br />Weinberger stated to vacate an easement a finding must be made that no public purpose exists <br />for the easement. The relocation of the utility and access easement would still allow the <br />propert)' to the west to gain access and sewer connection. Providing access to the north lot <br />would no longer be required since it has been acquired and combined with the Applicant’s lot. <br />The City of Orono has not received written confirmation back from all the utility companies at <br />this time. Weinberger stated the Planning Commission could make a recommendation of <br />approval with the condition that all utility companies have agreed to the vacation and <br />relocation of the easement. <br />PAGE 24
