MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />SEPTEMBER 18,2000 <br />(^2609 Alan Opheim, Continued) <br />into a three season porch, with the porch to be constructed on the existing concrete slab which <br />is located 6.9 feet from the side lot line where ten feet is required. The e.xisting concrete slab <br />and proposed three season porch is located approximately 80 feet from the OHWL and <br />encroaches into the average lakeshore setback by 73 feet. The porch will not alter the views of <br />the adjacent properties. <br />A variance to the average lakeshore setback is required to permit the structiu*e to encroach <br />73 feet into the average lakeshore setback. A side yard setback is also required to permit a <br />6.9 foot setback to the property line where ten feet is required. <br />Bottenberg noted the structural coverage on the lot will increase to 13 percent but is still below <br />the allowable 15 percent. The three season porch will not result in an increase in hardcover <br />coverage in the 75-250 zone. <br />City Staff recommends approval of the application. <br />There were no public comments regarding this application. <br />Smith moved, Kluth seconded, to recommend approval of Application ^#2609, Alan and <br />Maxine Opheim, 1985 Fagerness Point Road, granting of variances to the average lakeshore <br />Setback and side yard setback VOTE; Ayes 7, Nays 0. <br />CONTINUED PUBLIC HEARINGS <br />(UT) #2610 JEROME J. HALL, 80 LEAF STREET, VARIANCES, 10:16 p.m. - 10:30 p.m. <br />Jerome Hall, Applicant, and Mark Gronbcrg, Surveyor, were present. <br />Weinberger stated the Applicants are requesting approval of an afrer-the-fact variance to permit <br />replacement of a deck within the 75 foot setback to a protected tributary. The Applicant has <br />indicated the pre-existing deck was not safe and needed replacement. At the time the Applicant <br />applied for a building permit, it was discovered that it was within 75 feet of a protected <br />tributary. A variance is required to allow hardcover ^^ithin 75 feet of the ordinary high water <br />level of a tributary. <br />The deck would continue to provide a landing for a sliding glass door located at the rear of <br />the house, with the Applicant requesting an additional six feet at the south end. The additional <br />six feet would not be required for access to the door. <br />City Staff recommends approval of the variance to permit replacement of a deck and adding <br />six feet to the size of the deck based on the following fmdings; <br />1. A deck has existed for man> years in the location of the new deck. The additional six <br />feet of deck would be located 70 feet from the lakeshore and partially outside of the <br />75 feet setback. <br />PAGE 22
