Parcel 2 is an existing 4.5 acre parcel. About 2 acres of the parcel are located below the OHWL of <br />Dickey Lake or are designated as wetland. Lot area does not include those areas that are designated <br />as Dickey Lake or have been determined to be wetlands. The total existing lot size is 2.46 acres. <br />This would be reduced as 4,300 s.f. of land would be transferred to Parcel 1. <br />Pertinent Ordinances: <br />1. <br />2. <br />Section 10.28, Subdivision 5 - Lot standards for RR-IB zoning district. <br />Section 10.56 - Shoreland Overlay District <br />a.Subdivision 16 (C) - Required setbacks for structures and septic systems from the <br />OHWL of a Natural Environment Lake. <br />Required = 150' <br />b. Subdivision 16 (L) - Hardcover restrictions. Both Lots 1 and 2 will be subject to the <br />hardcover regulations for the Shoreland Overlay District. <br />Hardcover Restrictions <br />Both Parcels 1 and 2 are subject to hardcover restrictions from Dickey Lake and a protected tributary <br />located along the north property line of Parcel 1. Dickey’s Lake Creek has been identified as a <br />protected waterway and requires a 75' setback for structure and hardcover. An original plan was <br />submitted in August that proposed a driveway access for Parcel 2 along the north side of Parcel 1. <br />Staff suggested the access should remain south of Parcel 1 to not disturb the creek. A driveway <br />along the north property line would have required grading and hardcover within the protected area <br />of the creek. <br />A 300' shoreland protection area has been established around protected tributaries. The 300 ’ would <br />allow 0% hardcover within 75' of the high water level of the creek, 25% hardcover between 75-250' <br />from the creek and 30% from 250-300'. <br />Required Setbacks <br />Parcel 1 <br />Front Yard = 50 feet <br />Side Yard = 30 feet <br />Rear Yard = 50 feet <br />To protected tributary (north of property line) = 75 feet <br />Parcel 2 <br />Front Yard = 50 feet <br />Side Yard = 50 feet <br />Lakeshore = 150 feet* <br />* Dickey Lake has been classified as a Natural Environment Lake and requires a 150' setback for <br />structure and hardcover <br />#2615 George and Gloria Johnson <br />179 Brown Road South <br />Lot Line Rearrangement * Public Hearing <br />Page 2
