UI5_ _ _ _ _ <br />A RESOLUTION VACATING AN UNUSED PORTION OF <br />OROON STRSUT WITHIN THE PLAT OF DAYSIOE ADDITION <br />TO LAKE MINNETONKA, SECTION 5, TOWNSHIP 117, <br />RANGE 23 IN THE CITY OF ORONO, MINNESOTA <br />WHEREAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the Stato of Minnesota; and <br />WHEREAS, on March 3, 198«, Scott C. McLain and Debra McLain <br />filed a petition with the City of Orono requesting tho vacation of the <br />westerly 100 feet of Brook Street, Baysidc Addition to Lako Minnetonka, <br />Ken.nepin County; and <br />WHEREAS, after duo published and posted notice, a public <br />hearing was hold before tho City Planning Corjnissior. on March 19, 1984, <br />regarding said vacation and all persons interested wore given an <br />opportunity to bo heard; and <br />WHEREAS, after duo study and consideration, the Manning <br />Comr.ission roco.’nnendcc approval of the requested vacation and tho City <br />Council of tho City of Orono finds that said vacation, as proposed, is <br />in keeping with tho public interest in consideration of tho following <br />findings: <br />1.Tho vacation does not affect access to or uso of any <br />adjoining property <br />2. <br />3. <br />The City has not and docs not intend to develop, improve <br />or uso tho property in any way except for utilities and <br />accesfs purposes hcrcir.aitcr described <br />The property as it e.xists servos no public purpose <br />NOW, THEREFORE, 3E IT RESOLVED that the petition of Scott C. <br />McLain and Debra McLain is hereby granted and that that portion of <br />Brook Street Icg.illy doseriboc abov is hereby vacated. The granting <br />of the petition in subject to the following conditions: <br />1 Upo.n v.ic.ition, Scott C.
