n. <br />Application Date: 5/17/00 <br />60 Day Deadline: 9/15/00 <br />TO:Chair Hawn and Orono Planning Commission Members <br />Ron Moorse, City Administrator <br />FROM:Paul Weinberger, Zoning Administrator/Planner <br />DATE:August 16,2000 <br />SUBJECT:#2593 Ace Properties <br />3349 Crystal Bay Road <br />Variances - Public Hearing <br />Zoning District: <br />Lot Area: <br />LR-IC One Family Lakeshore Residential District (1/2 acre) <br />5,767 s.f. <br />866 s.f. of the lot area is the traveled portion of Crystal Bay Road and would <br />be deducted from the lot area of the lot. The actual lot area for zoning <br />purposes is 4,901 s.f. (.11 acre) <br />Application Summary: Originally this application was submitted for the June Planning <br />Commission Meeting. Upon Staff review of the original submittal the applicants were advised by <br />Staff the proposed house would not likely be approved. The applicants were willing to meet with <br />Staff and further discuss the proposal. The application was delayed and not forwarded to the <br />Planning Commission to allow' the applicants an opportunity to revise the plans and reduce the <br />amount of structure and hardcover proposed on the property. The applicants have submitted a new <br />plan set that has incorporated staff comments and is more consistent with the surrounding <br />development. <br />The existing house and garage total 1,080.4 s.f of structure and are located 1' off the east property <br />line. Proposed is a new structure 1,082 s.f. The new structure would be located in the center of the <br />property meeting the 10' side yard setback requirements. <br />This application requires the following variances* <br />1.Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L) to permit 836 s.f. (29%) <br />hardcover in the 0-75' setback where 768.4 (27%) exists and none is allowed, and 972 s.f. <br />(47%) hardcover in the 75-250' setback where 994 (48%) exists and 25% is allowed. <br />2.Section 10.55, Subdivision 8 permit the proposed residence 70' from the 929.4' lakeshore <br />where 75' is proposed, and Section 10.56, Subdivision 16 (C) (6) to permit the structure to <br />encroach 3 ’ into the average lakeshore setback. <br />3. <br />4. <br />Section 10.25, Subdivision 6 (B) tc permit an 8' rear yard setback where 30 ’ is required. <br />Section 10.25, Subdivision 6 (B) to permit new construction on the non-conforming lot. Lot <br />area is required to be 'A acre and lot width is 100’.
