1 <br />« m <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 3 4 72 ^ <br />A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 1, <br />SECTION 10.55, SUBDIVISION 8, <br />SECTION 10.56, SU'BDFVISION 16 (C) AND <br />SECTION 10.25, SUBDIVISION 6 (B) <br />FILE /j'1961 <br />WHEREAS, Warren Paschke (hereinafter "the applicant") is owner of the <br />property located at 3349 Crystal Bay Road within the City of Orono (hereinafter "City") and <br />legally described as follows: <br />Lot 10, Wallace’s Addition to the Village of Minnetonka Beach, Hennepin County, <br />Minnesota (hereinafter "the propeny"); and <br />WHEREAS, the applicant has applied to the City for variances to Municipal <br />Zoning Code Section 10.22, Subdivision 1,_Section 10.55, Subbdivision 8, and Section 10.56, <br />Subdivision 16 (C) to allow replacement of a deck and railing located lakeward of the average <br />lakeshore setback line and less than 75’ from the shoreline; and a vari^ce to Section 10.25, <br />Subdivision 6 (B) to allow such deck and railing to be replaced at a location 7.3 from the side <br />lot line where a 10’ side setback is normally required. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1.
